THE RULES ON LIABILITY ESTABLISHED BY THE WARSAW CONVENTION AND THE AMENDMENTS THEREOF SHALL APPLY TO THE INTERNATIONAL CARRIAGE OF ANY SHIPMENT TO THE EXTENT THAT SUCH CARRIAGE IS GOVERNED BY THE CONVENTION.

For the purposes of these Terms and Conditions, United Parcel Service means the United Parcel Service company operating in the country from which the shipment is consigned to Truong Hai Shipping International Vietnam Joint Stock Company (“Truong Hai Shipping International”) for the international transportation of small parcels (including “Express Mail”) and associated services. All shipments are subject to the terms and conditions set out in Truong Hai Shipping International’s Service Guide and Tariff (set out at

Truong Hai Shipping International.com and available at local Truong Hai Shipping International offices), the original document of Truong Hai Shipping International for each shipment and the original document is governed by the applicable jurisdictional law of the country of origin of the shipment. “Shipper” means the party contracting for services with Truong Hai Shipping International.

In the case of air transport with an ultimate destination or stopover outside the country of origin, the Warsaw Convention may apply. The rules relating to liability established by the Convention for the Unification of Certain Rules Relating to International Carriage by Air signed at Warsaw, Poland, on 12 October 1929, and any amendments thereto, shall apply to the international carriage of any shipment insofar as such carriage is governed by the Convention. If the parties have not agreed upon a stopping place at the time of consignment, Truong Hai Shipping International reserves the right to determine the routing of the shipment in any manner which Truong Hai Shipping International deems appropriate. Notwithstanding anything to the contrary, international carriage by road may be governed by the provisions of the Convention on Contracts for the International Carriage of Goods by Road signed at Geneva on 19 May 1956, and any amendments thereto (“CMR Convention”).

Truong Hai Shipping International may engage subcontractors to perform services and contracts on behalf of Truong Hai Shipping International and each of Truong Hai Shipping International’s employees, agents and subcontractors shall have the benefit of these terms. Neither party shall have the authority to waive or vary any of these terms. All packages or pallets included in a Bill of Lading/Consignment Note (“Truong Hai Shipping International Bill of Lading”) shall be deemed to be one shipment. A shipment shall be transported through any intermediate stopover point that Truong Hai Shipping International deems appropriate.

Unless otherwise agreed in writing prior to consignment, the services provided by Truong Hai Shipping International shall be limited to the collection, transportation, customs clearance as the case may be, and delivery of the shipment. The Shipper acknowledges that shipments will be consolidated with shipments of other shippers for transportation and that Truong Hai Shipping International may not be able to monitor the movement of each shipment in and out of all processing centers.

Terms and Conditions of Service

Truong Hai Shipping International provides general freight services as defined in the general terms
and subject to the following restrictions:

(i) Subject to the terms and conditions relating to Truong Hai Shipping International Worldwide Express Frieght below, Truong Hai Shipping International does not provide transportation services for any package or product that has an actual weight greater than 70 kg (or 150 lbs) or a length exceeding 270 cm (or 108 inches) or a combined length and girth exceeding 400 cm (or 157 inches). If present in the Truong Hai Shipping International system, such packages will be subject to one or more of the following additional surcharges: Over Maximum Length or Over
Maximum Dimension. Truong Hai Shipping International Worldwide Express Freight Services pallets that exceed the maximum size and weight limits as specified (in the Truong Hai Shipping International Rates and Services Guide) at Truong Hai Shipping International.com will not be accepted for shipment and will be returned to the shipper if they appear in the Truong Hai Shipping International system.

(ii) No service will be provided for the shipment of any package or item with an actual value exceeding VND 999,999,999 per package (or the local currency equivalent); or VND 999,999,999 per pallet for Truong Hai Shipping International Worldwide Express Freight Services shipments (or the local currency equivalent).

(iii) We do not provide transportation services for any package or pallet containing prohibited items listed on Truong Hai Shipping International’s website (Truong Hai Shipping International.com), including but not limited to valuable and rare items (such as coins, money, postage stamps, negotiable instruments (except checks), money orders, and dangerous goods. Please refer to Truong Hai Shipping International’s Rates and Services Guide for more information on dangerous goods. Under applicable law, some goods may only be transported under specific conditions and some goods are prohibited from being transported by air.

(iv) Truong Hai Shipping International does not provide protection for the transportation of perishable goods and items that need to be protected from extreme heat or cold. Such goods will only be accepted for transportation at the sender’s own risk for any damage that may occur during transportation.

(v) We do not provide transportation services for any shipments that are strictly prohibited from being transported by air. prohibited by applicable laws or regulations of the country of origin or destination, or when Truong Hai Shipping International determines that the shipment is prohibited. Prohibited items found within the Truong Hai Shipping International network or prohibited items not properly prepared in accordance with applicable regulations will be subject to additional prohibited item charges. Truong Hai Shipping International reserves the right to disclose, submit to authorities or return such packages to the sender at the shipper’s expense. Such charges apply in addition to all other applicable charges including all disposal charges.

The Shipper shall be responsible for the accuracy and completeness of the information included in the Bill of Lading and shall ensure that all shipments contain full contact details of the shipper and consignee and that the shipment is packed, marked and labelled, with the contents described and classified and accompanied by all necessary documentation (as the case may be) to ensure that it is suitable for carriage and complies with the requirements of the Tariff and Service Guide in force and applicable law.

Large Package Surcharge

An additional charge will apply to large packages. A package is considered a “Large Package” when the length plus girth [(2 x width) + (2 x height)] exceeds 300 cm (118 inches), but does not exceed the maximum size permitted by Truong Hai Shipping International of 400 cm (157 inches).

Large Packages will be shipped at an additional charge for a minimum billable weight of 40 kg (90 pounds).

A Handling Surcharge will not be charged where a Large Package Surcharge has been applied.

Over Maximum Surcharge

Packages that exceed the weight or size limits set forth in the Terms and Conditions (“Unacceptable Items”) are subject to one or more of the following surcharges:

Over Maximum Weight

Over Maximum Length, or Over Maximum Size. These surcharges will apply in addition to all other applicable charges, including but not limited to the Large Package Surcharge.
